2. Purpose of PAIA
The Promotion of Access to Information Act 2 of 2000 (PAIA) gives effect to the constitutional right of access to information held by private bodies where that information is required to exercise or protect a right. This manual explains what records FORTIVON holds and how to request access to them.
3. Information Regulator guide
The Information Regulator publishes a guide on how to use PAIA. It is available from the Information Regulator at inforeg.org.za.
4. Categories of records held
Company records (incorporation documents and statutory registers); financial and tax records; customer records (sourcing requests, uploaded references, quotations, order and delivery records, correspondence and customer account details); supplier records (supplier contact details, sourcing options and purchasing records); website and system records (access and security logs); and records required by other legislation. Some records may be refused on the grounds set out in PAIA, for example to protect the privacy of third parties or commercially confidential information.
5. Processing of personal information
How personal information is processed, the categories of data subjects, recipients, cross-border transfers and security measures are described in our Privacy Policy.
6. How to request access
Send a written request to luthando@fortivonsa.site using the prescribed PAIA request form (Form 2, available from the Information Regulator). Provide enough detail to identify the record, your contact details, the form of access you want, and the right you are seeking to exercise or protect. If you request on behalf of someone else, include proof of your authority. We will respond within the time periods set by PAIA.
7. Fees
A request fee and an access fee may be payable, as prescribed by the regulations under PAIA. We will tell you of any fee payable before processing the request. Requesters seeking their own personal information are not required to pay the request fee.
8. Information Regulator
If you are not satisfied with our response you may complain to the Information Regulator (South Africa): website inforeg.org.za, PAIA complaints PAIAComplaints@inforeg.org.za, general enquiries enquiries@inforeg.org.za. You may also apply to court.
9. Availability of this manual
This manual is published on our website and a copy is available on request by email.
